1. Acceptance of Terms

By creating an account or using Tesori in any way, you confirm that you are at least 13 years old and that you have the legal capacity to enter into this agreement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these terms on your behalf.

We may update these Terms at any time. Material changes will be communicated through the App or by email. Continued use after changes take effect constitutes acceptance of the revised terms.

2. Description of Service

Tesori is a personal product archive application for iOS. The App allows users to scan product barcodes, retrieve product information, save products to a personal archive, rate products, organize products into collections, and share collections with other users via a social profile. A discovery tab surfaces trending and highly-rated products across the community.

Tesori is provided on an "as available" basis. We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice where practicable.

3. User Accounts

You must create an account to use Tesori. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to:

• Provide accurate, current, and complete information when creating your account
• Keep your account information up to date
• Notify us promptly if you suspect unauthorized use of your account
• Use one account only; creating multiple accounts to circumvent restrictions or bans is prohibited

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User-Generated Content

Tesori allows you to create and upload content including product photos, ratings, collection names, and profile information (collectively, "User Content"). You retain ownership of your User Content.

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and distribute your User Content solely to operate and improve the App and its features. This license terminates when you delete the content.

You represent and warrant that:

• You own or have the necessary rights to any content you upload
• Your User Content does not infringe the intellectual property, privacy, or other rights of any third party
• Your User Content complies with these Terms and all applicable laws

We do not pre-screen User Content but reserve the right to remove any content that violates these Terms or that we find objectionable, without notice.

5. Prohibited Conduct

You agree not to use Tesori to:

• Post content that is unlawful, harmful, threatening, harassing, defamatory, obscene, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Upload content that infringes any copyright, trademark, patent, trade secret, or other intellectual property right
• Attempt to gain unauthorized access to any part of the App or its infrastructure
• Use automated means (bots, scrapers, crawlers) to access or collect data from the App
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Engage in spam, phishing, or any other deceptive practices
• Interfere with or disrupt the integrity or performance of the App
• Circumvent any subscription limits or access controls

Violation of these prohibitions may result in immediate account termination and, where appropriate, referral to law enforcement.

6. Subscriptions and Billing

Tesori offers a free tier and a paid subscription called Tesori Premium. Premium is available as a monthly plan ($3.99/month) or an annual plan ($24.99/year).

Purchase and payment. All subscriptions are purchased through the Apple App Store using Apple's in-app purchase system. By subscribing, you agree to Apple's Media Services Terms and Conditions. Payment is charged to your Apple ID account at confirmation of purchase.

Auto-renewal. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the price shown at the time of original purchase.

Cancellation. You may cancel your subscription at any time through your Apple ID account settings (Settings → [your name] → Subscriptions). Cancellation takes effect at the end of the current billing period; you retain access to Premium features until then. We do not issue refunds for partial periods.

Refunds. Refund requests are handled by Apple in accordance with their refund policies. We have no ability to issue refunds directly.

Price changes. We may change subscription pricing with reasonable advance notice. Existing subscribers will be notified through the App Store before any price change takes effect.

No free trial. Tesori Premium does not currently offer a free trial period.

7. Intellectual Property

The Tesori app, its design, logo, name, and all software are the property of Matthew Coufal and are protected by copyright and other applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, trade names, or other intellectual property without our prior written consent.

Product information retrieved through barcode scans is sourced from third-party databases. We make no warranty as to the accuracy or completeness of that information.

8. Privacy

Your use of Tesori is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

9. Disclaimer of Warranties

To the fullest extent permitted by law, Tesori is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any product information retrieved through the App.

Your use of the App is at your sole risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Matthew Coufal shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or loss of goodwill — arising out of or in connection with your use of (or inability to use) the App, even if advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the total amount you have paid us in the 12 months preceding the claim, or $10 USD, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitation may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Matthew Coufal from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or relating to your use of the App, your User Content, or your violation of these Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the App shall be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.

13. Termination

You may stop using the App at any time. We may suspend or terminate your access at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive.
